Power VL, Inc. and its subsidiaries and affiliates (“Power VL,” “we,” “us,” or “our”) take your privacy seriously and are committed to being transparent about how we collect, use, share, and protect your personal information. 


This Privacy Policy tells you:

If you do not want us to handle your personal information as described in this Privacy Policy, please do not use the Power VL Platform. Personal information is information that could reasonably be used to identify you individually, such as your name, e-mail address, and mobile number.


If you are applying for a job or contract position at a company (“Employer”) through the Power VL Platform or are employed or contracted with an Employer that uses Power VL's services, all the personal information you enter into the Sites is stored on Power VL's database and servers and made available to the Employer. This Privacy Policy does not cover the Employer's handling of your personal information. Power VL will only provide your information to an Employer at your specific direction. Power VL does not share your information with Employers that you do not direct us to. Please refer to the Employer's privacy policy or contact the Employer with any questions about the Employer's use and disclosure of your personal information.


If you are a customer of Power VL or a user of Power VL's Services (“Client”), the terms governing the use of your data are governed by the Master Service Agreement with Power VL Terms of Service. We do not share one Client's data with another Client—never have, never will. We do not provide your data to third parties without your direction and written authorization to do so. The Power VL Platform is intended for a U.S. or Canadian audience. Any information you provide, including any personal information, will be transferred to, and processed by, a computer server located within the United States and will be handled in accordance with this Privacy Policy.


WHAT PERSONAL INFORMATION WE COLLECT

Information You Give Us
We collect personal information that you voluntarily share with us through the Power VL Platform. For example, we collect information from you when you fill out an application, complete and sign forms, surveys, other documents, or training on the Power VL Platform.


The information that you may choose to provide includes:

  • Contact information, including name, address, email address, and telephone number
  • Job application information, including employment history, driver's license      number, and traffic violation and accident history
  • Information submitted in order to allow the Employer to run a background check or FMCSA Clearinghouse check including name, date of birth, and social      security number
  • Communications sent to the Employer, for example, messaging within the text messages or communications shared through SMS
  • An image of your driver's license, Social Security card, Med Card, or pictures of yourself
  • Information provided on forms, documents, surveys, or driver training that you      complete and/or sign via the Power VL Platform
  • “Likes” and other expressions of interest in a company or work opportunity


Information We Collect Through Technology on the Power VL Platform
We collect information through technology to enhance our ability to serve you. When you access and use the Power VL Platform, Power VL collects information about how you interact with the Power VL Platform.


When you visit the Power VL Platform, we collect your device identifier, browser information, and Internet Protocol (IP) address. While an IP address may reveal your ISP or geographic area, we cannot determine your identity solely based upon your IP address. However, we do not link your personal information to device identifier information, browser information, and IP addresses.


We may also collect Platform Usage Information such as how much time you spend using the Power VL Platform, frequency of use, and your actions. We may link this to your personal information.


Do We Use Cookies?
Yes. Cookies are used to recognize your browser and retain session information. Third-party service providers may assist us in using cookies on the Power VL Platform.

Employers may also place cookies on the Power VL Platform independently. This data is managed under the Employer’s privacy policy. You may disable cookies in your browser, but this may affect functionality.


Your ‘Do Not Track’ Browser Setting
Power VL does not currently respond to DNT signals due to the lack of a universal standard. Learn more at http://allaboutdnt.com.


Information You Provide to a Third Party
The Power VL Platform may contain links to third-party websites. Power VL is not responsible for the privacy practices of these websites.


Information Third Parties Provide About You
We may receive your information from third parties (e.g., job boards, Employers) and combine it with information collected directly via the Power VL Platform.


Text (SMS) Messages
If you consent, Power VL may capture, log, and store SMS messages exchanged with an Employer. These messages may be handled by subcontractors, but will not be used for marketing purposes.

Power VL uses the data to:

  • Help you apply to and communicate with Employers
  • Support onboarding through documents and surveys
  • Show you relevant job opportunities
  • Deliver notifications and SMS communications
  • Improve user experience and troubleshoot technical issues
  • Ensure compliance and prevent fraud


Data Retention


Data is retained per Employer policy and applicable law.

  

HOW WE SHARE THE PERSONAL INFORMATION WE COLLECT

We do not sell your data. We share it:

  • With your designated Employer
  • With Employers you show interest in
  • At the direction of the Employer (e.g., background checks)
  • With third-party service providers under contract with Power VL (e.g., rewards,      surveys, analytics, legal services)
  • In aggregated or anonymized form
  • When required by law or to enforce policies
  • As part of a corporate transaction (e.g., merger or sale)

  

CHILDREN’S ONLINE PRIVACY PROTECTION ACT COMPLIANCE
The Power VL Platform is not for users under age 13. We do not knowingly collect data from children under 13.

  

HOW WE PROTECT THE PERSONAL INFORMATION WE COLLECT

We use administrative, physical, and technical safeguards such as:

  • TLS encryption
  • Limited internal access to personal data
  • Staff training on privacy and security

Despite safeguards, no system is completely secure. Users should also take steps to protect their own account information.

  

Ownership of Information and Materials You Voluntarily Submit to Power VL via the Site

Except as otherwise provided in any Terms and Conditions applicable to the Site, Power VL is the sole owner of any information that you submit through the Site, including any photos, documents, works of authorship, feedback, testimonials, or other materials (“Contributed Materials”) that you voluntarily provide. By submitting such content, you grant Power VL a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, adapt, publish, translate, and distribute the Contributed Materials in any existing or future media for business, promotional, and operational purposes.


Power VL is not required to return any Contributed Materials and reserves the right to delete, modify, or create derivative works based on them prior to or during their use. This includes editing for clarity, formatting, branding consistency, or other business-related needs, except where prohibited by applicable copyright or intellectual property laws.

If you submit Contributed Materials on behalf of another person or entity, you represent and warrant that you have obtained all necessary permissions to do so. Minors (individuals under the age of 18) must not submit Contributed Materials without express consent from a parent or legal guardian. Power VL disclaims any liability arising from unauthorized or unlawful submissions.

  

Biometric Information Security Policy


Power VL is committed to safeguarding all biometric data collected in the course of its operations. We recognize that Biometric Information is uniquely sensitive and requires the highest level of protection due to its immutable nature and potential for misuse.

This policy outlines how Power VL, its contractors, vendors, and affiliates collect, use, store, secure, and ultimately destroy Biometric Information in compliance with applicable laws and ethical best practices.


Definitions

(As previously listed; definitions unchanged, with inclusion of “Encrypted,” “Security Breach,” “Security Incident,” etc.)


Collection and Consent

Power VL will not collect or use an individual's Biometric Information without:

  • Providing written notice that clearly explains the specific purpose and length of      time for which the data is being collected, stored, and used; and
  • Obtaining written or electronically signed consent from the individual (or their      legal representative, if applicable).


This consent will be stored securely and may be withdrawn at any time by the individual, in accordance with our data subject rights policy. Withdrawal of consent will result in immediate cessation of further biometric data collection and initiation of destruction protocols.


Vendor and Contractor Obligations

Vendors and contractors acting on behalf of Power VL and processing Biometric Information must:

  • Sign a written agreement binding them to comply with this policy and all      applicable laws
  • Demonstrate that they implement technical and administrative safeguards at least as strong as those required by Power VL
  • Notify Power VL of any breach, suspected breach, or non-compliance      involving Biometric Information within 24 hours


Power VL retains the right to audit vendors and third parties to confirm their compliance with this policy.


Use Limitations


Power VL may only use Biometric Information for the purposes disclosed at the time of collection, including but not limited to:

  • Identity verification
  • Timekeeping and attendance systems
  • Secure system access
  • Regulatory compliance


Use of Biometric Information for marketing, profiling, or any other secondary purpose is strictly prohibited.

  

Disclosure of Biometric Information

Biometric Information will not be disclosed or disseminated to any third party except:

  • With explicit consent from the subject or their legally authorized representative
  • To complete a transaction authorized by the subject
  • In compliance with a legal obligation (e.g., subpoena, court order, or      regulatory inquiry)
  • In response to security or fraud investigations with proper authorization


In any such case, disclosure must be limited to the minimum necessary to fulfill the request.

  

Security Safeguards

To protect Biometric Information, Power VL implements:

  • Role-based access control (RBAC) and least privilege access policies
  • End-to-end encryption of biometric data in transit and at rest
  • Regular audits and penetration testing of biometric storage systems
  • Biometric data logging and access monitoring with audit trails
  • Secure destruction methods for all Biometric Information, both electronic and      paper-based


Paper documents are to be locked when not in use and destroyed using shredding or incineration. Electronic files are securely wiped using industry-standard data destruction tools.

  

Retention and Destruction of Biometric Information

Power VL retains Biometric Information:

  • Only for as long as it is necessary to fulfill the original business purpose; or
  • For up to two (2) years after the termination of employment or contractor engagement, whichever comes first


When the retention period ends or the business need is no longer applicable, Power VL will permanently destroy all Biometric Information. Destruction will be overseen by designated staff in the People Team and Engineering and Technology Department, ensuring methods render the data irretrievable. If subject to a litigation hold, investigation, or subpoena, destruction will be paused and resumed only when compliance allows.

  

Policy Enforcement and Reporting

Violations of this policy—whether internal or external—will be investigated and may result in disciplinary action, up to and including termination of employment or contractual relationship, and potential legal liability. All suspected or actual breaches involving Biometric Information must be reported immediately to the Security Incident Response Team (SIRT). Notifications to affected individuals and regulatory bodies will be handled in accordance with applicable breach notification laws.

Scope


This Section applies exclusively to the personal information of residents of the U.S. state of California in their capacity as consumers (“California consumers”). For example, Power VL may handle the personal information of California consumers when providing matching services through Power VL’s applications or when storing personal information at a driver's request in order to auto-fill online job application forms.


“California consumer” does NOT include:

  • Individuals in their capacity as human resources personnel with respect to Power VL (e.g., employees or job applicants at Power VL);
  • Individuals acting as emergency contacts, dependents, or beneficiaries of HR individuals;
  • Individuals in their capacity as employees, contractors, or agents of Power VL’s      partners, service providers, or vendors;
  • Individuals whose personal information is handled solely in Power VL’s capacity as a service provider for its clients (e.g., via an online application portal      hosted for a client carrier).


This section applies to all personal information collected or disclosed for business purposes by Power VL, regardless of the collection method (website, mobile app, or otherwise). Power VL does not sell California consumers’ personal information.

Your Rights


  • Right to Know – California consumers may request details about the      categories and specific pieces of personal information collected, its sources, and how it’s used and disclosed.
  • Right to Delete – You may request that Power VL delete your personal      information, subject to applicable legal exceptions.
  • Right to Opt Out of Sale – While Power VL does not sell personal      information, this right applies generally under California law.
  • Right to Non-Discrimination – Power VL will not deny services, charge     different prices, or discriminate against you for exercising your privacy rights.

Verifying Your Request

We verify identity using the following methods:

  • Requests to Know Categories or Purposes: We require a match of two data      points (e.g., zip code, phone number).
  • Requests to Know Specific Information: We require a match of three data      points, and possibly a signed declaration under penalty of perjury.
  • Requests to Delete: Depending on sensitivity, we may require two or three      data points, and possibly a signed declaration.


If identity cannot be verified, we will notify you and delete any verification data used during the process.

  

Authorized Agents

You may authorize another person to submit requests on your behalf by providing:

  • A valid power of attorney; or
  • A signed written authorization; and
  • You may still be required to verify your identity directly.

  

Non-Discrimination

Power VL will not discriminate against California consumers for exercising their rights under the California Consumer Privacy Act (CCPA).
